Submitting an Appeal

In case of disagreement with the results received from LLC “G-TEST” (hereinafter referred to as the Company), the applicant has the right to file an appeal with the Company within fifteen days after receiving the documents. The appellant submits an official claim outlining the essence of the conflict addressed to the Director. The Company confirms receipt of the appeal and provides the filer with a copy of the appeal bearing a receipt mark.

Appeals may be filed in the following cases:

    Refusal to consider an application for certification or in case of a negative decision by the certification body

    Refusal to issue a product certificate of conformity

  • 3

    Cancellation or suspension of the certificate of conformity

  • 4

    In cases of controversial issues regarding the conformity or non-conformity of products to the requirements of regulatory documents

    Disagreement with test results

Upon registration of the Appeal by the Director of the Company, an appeals commission is created to review it. The composition of the appeals commission is determined by the Director's order. Members of the commission may include experts from other organizations, scientific and technical societies and associations, consumer associations, as well as specialists from other enterprises and organizations. Commission members must be independent of all conflicting parties.

The composition of the appeal committee is agreed upon by the parties involved in the dispute. The secretary of the appeals commission is not a member of the commission and has no voting rights. Their duties include receiving appeals and preparing all necessary materials for their review. Upon receipt of the appeal, the secretary of the appeals commission requests the appellant within three days to provide information (additional materials) necessary for an objective review of the disputed issue within two weeks.

Documents containing the statement of claim, along with additional information, must be sent to the members of the appeals commission. The appeals commission considers the applicant's claims at meetings or through correspondence while maintaining confidentiality. Interested parties are notified of the date of the appeal review and the proposed agenda five days in advance. Representatives of the conflicting parties have the right to attend the meeting as observers.

Members of the commission must study the submitted materials, interview the conflicting parties and experts in order to objectively analyze the essence of the claim and make a decision.

The appeals commission makes decisions by a simple majority vote. The chairman does not participate in voting. However, if the votes are divided equally, the chairman makes the decision. The decision of the appeals commission must be rendered no later than one month after the filing of the appeal.

After considering the appeal, a protocol is drawn up. Confidential information is included in appendices that are not open for public review. The appeal review protocol is prepared in a free form and transmitted to all interested parties. The decision is considered accepted if no objections are received within two weeks. If one of the conflicting parties disagrees with the decision of the appeals commission, they have the right to apply to the National Certification Body of the Republic of Uzbekistan or to court within fifteen days.
